Naghain si Vice President Sara Duterte ng petisyon sa Korte Suprema na humahamon sa validity at constitutionality ng pang-apat na impeachment complaint laban sa kanya.
Ang petition for certiorari and prohibition with urgent application of temporary restraining order and/or writ of preliminary injunction ay inihain kahapon.
Ang mga respondents sa petisyon ay Kamara, na kinakatawan ni Speaker Martin Romualdez; ang Senado na kinakatawan ni Senate President Francisco Escudero; at House Secretary General Reginald Velasco.
Sinabi ng Fortun, Navasa & Salazar law firm, hinihiling sa petisyon ang intervention ng SC para itatupad ang due process at naglalatag ng mga alalahanin sa usaping legal at constitutionality kaugnay sa pang-apat na impeachment complaint.
Samantala, sinabi ni SC spokesperson Atty. Camille Ting, hindi kasama sa en banc agenda ng High Court ang petisyon ni Duterte.
Matatandaan na inihain ang impeachment complaints laban Duterte noong December 2024, kung saan lahat ay may kaugnayan sa alegasyon ng misuse ng confidential funds.
Ang pang-apat na impeachment complaint ang inindorso ng mahigit one-third ng mga kongresista, at sumunod ay ipinadala sa Senado.
Ang pitong Articles of Impeachment laban kay Vice President Duterte ay ang mga sumusunod:
Conspiracy to assassinate President Ferdinand Marcos Jr., First Lady Liza Marcos, and Speaker Martin Romualdez;
Malversation of P612.5 million in confidential funds with questionable liquidation documents;
Bribery and corruption in the Department of Education (DepEd) during Duterte’s tenure as Education Secretary, involving former DepEd officials;
Unexplained wealth and failure to disclose assets in her Statement of Assets, Liabilities, and Net Worth (SALN), with her wealth reportedly increasing fourfold from 2007 to 2017;
Involvement in extrajudicial killings in Davao City;
Destabilization and public disorder efforts, including boycotting the State of the Nation Address (SONA) while declaring herself “designated survivor,” leading rallies calling for Marcos Jr.’s resignation, obstructing congressional investigations, and issuing threats against top officials; and
The totality of her conduct as Vice President.
